Terms of Service

Welcome to Tripo. These Terms of Service ("Terms") govern your access to and use of the Tripo mobile application, website, and related services (collectively, the "Service"). By creating an account or using Tripo, you agree to be bound by these Terms.

Plain-English summary: Be respectful, don't break the law, don't try to break the app, and remember that other users' content is not necessarily endorsed by us. We try our best to keep Tripo running, but we can't guarantee perfection.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Tripo. By using the Service you confirm that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using Tripo on behalf of an organization, you confirm you have authority to bind that organization.

2. Your account

To use Tripo you must create an account, typically by signing in with Google or another supported identity provider. You agree to:

3. What Tripo does

Tripo helps groups plan and run trips together. Through the app you can create trips, invite friends, vote on activities, chat, find local guides, book accommodation, and split expenses. Some features may be offered by third parties (for example, accommodation providers or payment processors). Your interactions with those third parties are governed by their own terms.

4. User content

You retain ownership of the content you post in Tripo (photos, messages, itineraries, reviews, etc.) — "User Content". By posting User Content, you grant Tripo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating and improving the Service.

You represent that you own or have the necessary rights to your User Content, and that posting it does not violate any law or any other person's rights.

6. Guides and bookings

Tripo may connect you with independent local guides and accommodation providers. These providers are not employees or agents of Tripo. We are not responsible for the quality, safety, legality, or accuracy of services offered by third parties. Any contract you enter into with a guide or provider is solely between you and them.

7. Payments

Some features may involve payments (for example, paid programs with guides or accommodation reservations). Payments are processed by third-party providers such as Stripe. By making a payment, you agree to the payment provider's terms. Refunds, when available, are subject to the specific provider's policy and applicable law.

8. Intellectual property

Tripo, its logo, design, code, and all associated content (other than User Content) are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.

9. Third-party services

The Service relies on third-party providers for authentication (Auth0, Google), analytics, hosting, push notifications, and payments. Their terms and privacy policies apply when you use their parts of the Service.

10. Disclaimers

Tripo is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Tripo and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) 50 EUR.

12. Indemnification

You agree to indemnify and hold harmless Tripo, its officers, employees, and affiliates from any claim, damage, or expense (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

13. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. You may stop using Tripo and delete your account at any time. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will continue to apply.

14. Changes to the Service or Terms

We may add, change, or remove features at any time. We may also update these Terms; when we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of Tripo after the effective date constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of [your country / state], without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively before the competent courts of [your jurisdiction], unless mandatory consumer protection laws give you the right to sue in your local courts.

16. Apple App Store additional terms

If you downloaded Tripo from the Apple App Store, these additional terms apply: (a) these Terms are between you and Tripo, not Apple, and Apple is not responsible for the app or its content; (b) Apple has no obligation to provide maintenance or support for the app; (c) in the event of any failure of the app to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any); (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.
